Terms of Service

1. Acceptance of Terms

By accessing this website (the "Site") or engaging the services of BAC Builders, LLC ("BAC Builders," "we," "us," or "our"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Site or our services.

2. About BAC Builders

BAC Builders, LLC is operated by Brian Cappucci, a Florida Certified General Contractor (CGC1531080) and licensed Real Estate Sales Associate (SL3538466) affiliated with Key Real Estate in Fort Myers, Florida. Brian serves residential and commercial clients throughout Lee, Collier, and Charlotte counties.

3. Website Use

Permitted Use

You may use the Site for lawful purposes, including to learn about our services, request estimates, and contact us. The Site and its content are the property of BAC Builders, LLC.

Prohibited Use

You may not:

  • Copy, reproduce, or republish Site content without written permission
  • Use the Site for any unlawful purpose or in violation of any regulations
  • Transmit any unsolicited or unauthorized advertising or promotional material

4. Estimate and Proposal Terms

Free estimates and project proposals provided by BAC Builders are non-binding until both parties have signed a written construction contract. Estimates are valid for 30 days from the date issued, unless otherwise specified. Actual project costs may differ from estimates based on site conditions, material price changes, or scope modifications discovered during construction.

5. Construction Services

Scope of Work

All construction work is governed by a written contract that defines the scope, timeline, payment schedule, and warranty terms. No verbal agreement shall modify a written contract.

Permits and Code Compliance

As a Florida Certified General Contractor, Brian Cappucci is responsible for obtaining required building permits for contracted work. Clients are responsible for providing accurate property information, HOA restrictions, and deed covenants that may affect the scope of work.

Payment

Payment terms are specified in each project contract. Florida law (F.S. 713) governs construction liens. BAC Builders reserves the right to place a lien on property for non-payment of amounts due under a valid contract.

Warranty

BAC Builders warrants its workmanship for one (1) year from the date of substantial completion, unless otherwise specified in the project contract. Manufacturer warranties on materials are passed through to the client where applicable. This warranty does not cover damage from misuse, abuse, neglect, or acts of nature.

Dispute Resolution

Any dispute arising from a construction contract shall first be addressed through good-faith negotiation. If unresolved, disputes shall be subject to binding arbitration in Lee County, Florida, under the rules of the American Arbitration Association, unless both parties agree otherwise in writing.

6. Real Estate Services

Brian Cappucci's real estate brokerage services are governed by a separate Buyer/Seller Representation Agreement and comply with Florida Statute 475 and FREC regulations. The real estate services described on this Site constitute general information only and do not create a brokerage relationship without a signed agreement.

Real estate transactions involve inherent risks. Brian Cappucci does not guarantee the sale price, purchase price, or any other outcome of a real estate transaction. Past performance does not predict future results.

7. No Contractor-Client Relationship from Website

Visiting this Site, submitting a contact form, or receiving a response from Brian Cappucci does not create a contractor-client relationship. A formal relationship is established only upon execution of a written contract signed by both parties.

8. Intellectual Property

All content on this Site — including text, images, logos, and design — is owned by or licensed to BAC Builders, LLC. Unsplash images are used under the Unsplash License. Nothing on this Site grants any license to use our intellectual property without prior written consent.

9. Disclaimers

THE SITE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. BAC BUILDERS DOES NOT WARRANT THAT THE SITE WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless BAC Builders, LLC and Brian Cappucci from any claims, losses, liabilities, expenses, and costs (including reasonable attorneys' fees) arising from your use of the Site, violation of these Terms, or breach of any representation you make.

12. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any legal action not subject to arbitration shall be brought exclusively in Lee County, Florida.
